Terms and Conditions for Job seeker & Job Provider: The following Terms and Conditions shall apply to any user who uses Youth Point (www.youthpoint.in) & our services. All the conditions are deemed to be fully read, understood and accepted by the user. Meanings: The below Conditions, following words and phrases shall have the following meanings, unless the context requires otherwise: Advertisement: Any Advertisement issued by Youth Point on behalf of the Client. Applicant: A Candidate who applies for a vacancy advertised on the Youth Point. Candidate: A person who uses the Youth Point for the purpose of finding employment. Client: The person(s) who have agreed mutually to our services of the Youth Point. Resume: The curriculum vitae or brief outline details of itemizing their Educational Background, Work Experience & Other special skills to be mentioned truthful to their knowledge which is provided to Youth Point by a Candidate and will be forwarded to Clients with a view to securing employment. The Applicant hereby realizes that: The Particular Candidate details and resumes will be saved or restore in youth Point and will forward to HR People based on Company requirement. If any of the information’s are found to be false, we have rights to remove your details and terminate our services and even legal formalities would be taken if necessary. Applications and Applications Forms: If the Candidate makes an Application or is required to complete an Application by their own, the provisions of this clause shall apply thereto. The Candidate hereby understands that: They have to fully read and understood the requirements advertised by the Youth Point before apply. They must have the appropriate skills and qualifications required by the Client. The details they provide to the Client in an Application Form are to be true and accurate reflection of their Educational Background, Work Experience & Other special skills. That if any of the information used in an Application Form is found to be false or inaccurate, then Youth Point reserves the right to remove those details and terminate our services for the Particular Candidate. Youth Point has the right, at its sole discretion to decline to forward or to suspend any Application form accepted by us. Youth Point may refuse, withdraw, or require to be amended any Applications which is illegal, immoral, obscene or offensive or so as to comply with the legal or moral obligations placed upon Youth Point. The Candidate, to avoid infringing a third party^s rights or any statutory or regulatory requirements or is designed to or is likely to cause disruption to any computer system or network. When a Candidate makes an Application, Youth Point will do forward the Candidate^s details to the Client who announced the Advertisement of an employment. Youth Point won’t responsible for client’s Job posting and even though client rejection, selection, holding taken by corporate. Remain candidates has to ensure. Accountability Youth Point will not be liable (whether in contract or tort) for: Any loss of data, Resumes, or other materials that the Candidate supplies to www.youthpoint.in. Any mistakes that arise by candidate or staffs during the training Services or damage beyond its reasonable control and thereto in each case, as a result of circumstances is to omissions of the Candidate or Staffs For any failure to secure employment or consequential loss (whether caused by the negligence of www.youthpoint.in, its employees or agents). Any delay, costs, expense, loss, damage or liability (including without limitation as a result of any use of software, virus, deletion, corruption, loss or removal of data) howsoever caused arising from any matter beyond the reasonable control of Youth Point or as a result of the acts or omissions of the Candidate. Any loss or damage whatsoever howsoever caused, arising out of the negligence, dishonesty, misconduct, breach of faith, incompetence, or the wrongful disclosure of confidential information by, any Client. It is for the Candidate to satisfy itself as to the integrity and reliability of all vacancy Advertisements placed on the www.youthpoint.in. Any breach of agreement or infringement or violation of any right of any person or be rendered liable to any proceedings whatsoever, as a result of any information or Resume or Application submitted to it by the Candidate and the Candidate identifies Youth Point Against all costs, claims, damages, loss, expenses and liabilities suffered or incurred by Youth Point as a result of this undertaking and warranty being incorrect. The Candidate agrees and acknowledges that no condition, warranty or representation of any kind is, has been, or will be, given by or on behalf of Youth Point in respect of or in connection with the Services and accordingly the Candidate confirms that it has not, in accepting these Conditions, relied on any condition, warranty or representation by Youth Point or any person on its behalf, express or implied, whether arising by law or otherwise in relation to or in connection with the Services. The benefit of any such condition, warranty or representation by Youth Point is hereby irrevocably and unconditionally waived by the Candidate. Termination and Cancellation These Conditions apply unless replaced by subsequent Conditions. The Candidate shall be responsible for all reasonable costs, claims, damages, loss, expenses and liabilities incurred by Youth Point arising out of the Candidate^s breach of its obligations under these Conditions (including, without limitation, on a solicitor and own client basis, any legal fees and disbursements reasonably incurred by www.youthpoint.in). General Candidate: If any amount, certificates or any other document is hold on to company side, we won’t liable for any consequences .We advice to candidates, not to handover any certificates to corporate. If any health or other problems occurred to candidates while working in the company directly or indirectly, Youth Point won^t responsible. It’s up to candidate & company^s mutual understanding. We won’t ask any pay from candidates for placements. If any loss of money or document by the unknowing person, we won’t liable. If any issues in salary, promotion and other benefits and extra by company, youth point will not be responsible. Our advice to the candidates before joining, enquire properly. If satisfy join or omit. However, it’s up to candidate decision. Youth Point won’t refund Training fee at any cause & we have full rights to modify terms & Conditions at the required time. Beyond the terms & Conditions, if any violence occurs from candidate, have to face legal actions taken by Youth Point. At any cause & circumstances, we are not liable for any issue to the candidate by the company. The candidate should understand that Youth Point, just referring jobs and the whole details of company & Job Nature, Salary, Services should be observed and clear only by the candidate. It’s up to candidate decision. Company: Any documents or office premise things would take by candidate knowingly or unknowingly or if any misbehavior, rudeness & other physical and mental attack or actions occurred by the candidate, Youth Point won’t liable for those activities. Again, We Youth Point just refers jobs. The Company should get to observe the entire details, the behavior of the candidate while on interview & joining. It’s all up to company & candidate’s mutual understanding. If any provision of these Conditions shall be invalid or unenforceable, it shall not affect any other provision, which shall remain in full force and effect. Any waiver by Youth Point of any breach of, or any default under, any provision of these Conditions by the Candidate will not be deemed to be a waiver of any subsequent breach or default and will in no way affect the other terms of these Conditions. In the name of Youth Point, if you loss any amount in outsider / other parties, we are not responsible. Our Domain name: www.youthpoint.in, where you can verify and get cleared. We are not appointed any third parties / branches / premises in outside, If appoint in the future will publish in our official website. If candidates do any force / violence / harassment against Youth Point whether directly / indirectly, we will take legal action. We try to provide best offer, if we get affordable opening. If candidates selected through Youth Point referral, we suggest you (candidates) to enquire necessary data against Concern Company / industry before joining. In case if any problem occurs we are not responsible. Youth Point rules and regulations may change whenever we want, accord to circumstances and it’s up to our decision. It’s suitable for existing job Seeker and as well as an upcoming job seeker. Youth Point not responsible for any kind of mistakes, problems during a job search or after the job, whether directly or indirectly, here we just refer job. We will not ask to pay any amount to company or consultancy, if you loss in the future, we won’t responsible. And salary problems, certificate holding problems, security issues, organization colic problems, organization problems, Health issues, Accident problems and for kind negatives or problems occur in youth point, future or pre service, we are not liable. Our clear view is only job referrals. 100% we are not responding to any kind of negative and if any problems occur in future in the organization or candidates end. That’s all about the candidates and organization mutual risk. Others Youth Point won’t liable for salary issues, corporate issues, health issues & any kind of troubles after recommending jobs. We just refer jobs, and won’t liable for pre and post harms after recommending jobs in future by any routes. Youth Point will charge from candidates only for Training. Once logged we won’t pay back training fee to any extent. There is no training fee for a free jobs applicant. An Interview date will be confirmed based on client approval and candidate acknowledgement. If candidates failed to attend, we won’t schedule further interview. Beyond the terms & conditions, if any violence occurs from the candidate by directly or indirectly, the concern person has to face legal actions taken by Youth Point. Accessibility: Youth Point will use corporate name, logo, link and all other relevant for procuring resume’s purpose through www.youthpoint.in, job portals and all other social media. In same case we will provide candidates personal information to companies for interview purpose. In all cases, if any thins problem occurred, then Youth Point will not liable. Again, we are here to connect candidates and companies for employment offer, if there is any difficulty occurs we won’t accountable. In some cases, if candidates agree to take Youth Point training session, they have to pay training fees but not exactly for placement & free jobs. For above both categories it depends of Youth Point own decision. At clearly in Job Placement service section in youth point, we just a bridge of both job provider and job Seeker, both of them request to take their safety instruction. In any case / any circumstances / any cause we are not responsible for any kind of issue, that’s all end of Job Provider and Job seeker risk. Failure or delay by Youth Point in enforcing or partially enforcing any provision of these Conditions will not be construed as a waiver of any of its rights under these Conditions. Youth Point does not make any representation whatsoever about any Advertisement accessed either on, by virtue of or by way of any links from the Youth Point or about any of the Clients who use Services on the www.youthpoint.in. Youth Point trusts on information provided to it by Clients and via third parties and accordingly it is a matter for the Candidate to satisfy itself as to the suitability of any Client using Services on Youth Point or of any Advertisement found directly or indirectly through the www.youthpoint.in .Youth Point shall be entitled at any time without notifying the Candidate to make changes to our Services which are necessary to comply with any applicable security or other statutory requirements and shall determine the manner in which the Services are provided. Youth Point not responsible for candidates’ negative characters and activities, etc. & we just referring job. And also we are not responsible for any kind negative activities against the company / organization if candidates done. That’s all Job Providers risk. Any intellectual property, ideas, concepts, know-how or techniques developed by obtained during the execution of the Services will be owned exclusively by www.youthpoint.in Youth Point shall not be responsible for failure to provide the Services, or unavailability of the www.youthpoint.in, as a result of circumstances beyond its reasonable control. The Candidate agrees to provide www.youthpoint.in, in such a format as Youth Point may request, any information necessary to enable Youth Point to provide those Services. Youth Point shall not be obliged to provide those Services until the Candidate has supplied it with the information, necessary to provide those Services. Youth Point does not include any contact details (email, web URL or telephone number) in the job posting. Candidates should apply through the platform and not by any other means. In the event Youth Point detects any job posting that is not fulfilling this policy, will have the right to deactivate Job and Customer Account without any previous notice. We will be post Company requirement in all social networks with Company logo, name and other details for procure resumes to close. If we saved the candidate details and stored a Resume on www.youthpoint.in the provisions of this clause shall apply thereto. Youth Point will only make available or supply copies of the Resumes which have been received by it to forward to Clients of Youth Point solely for the purpose of securing suitable employment for the Candidate. Youth Point cannot guarantee the minimum number of times a Resume will be viewed by or distributed to Clients on any given day. We are completely not responsible for our youth point referral candidate’s problems. Here we for Only Job referrals moreover we can^t trace candidate character and activities etc that is up to organization risk. Law These Conditions and any contract, into which these Conditions are incorporated, shall be governed by and construed in accordance with Indian law.
